Thousands of medically retired veterans qualify for retroactive combat disability pay after Supreme Court ruling

Stars and Stripes | Linda F. Hersey | June 17, 2025

WASHINGTON — Thousands of medically retired veterans are eligible for additional retroactive combat disability pay following a Supreme Court decision that ends a cap on compensation for individuals with less than 20 years of service. The court unanimously ruled in favor of Marine Corps veteran Simon Soto, who filed a class-action lawsuit arguing the federal government incorrectly reduced the combat-related special compensation that he received after military service.

Under federal law, retired veterans waive a portion of their military retirement pay to receive disability benefits from the Department of Veterans Affairs. But veterans receiving combat-related disability pay are an exception under a statute that Congress passed in 2008, according to the Supreme Court decision issued June 12. [READ MORE...]

A Message From Mayor Adams:
Each week DVS shares a brief update about how our administration is getting stuff done for New Yorkers.
Our administration works every day to create a more affordable and livable city, and that’s why we’re making sure every family has access to safe, clean spaces to play and enjoy the outdoors. Last Sunday, we proudly cut the ribbon on two newly renovated NYCHA playgrounds and announced a $23 million investment to revitalize nearly three acres of open space across three NYCHA developments. These parks will not only serve NYCHA residents but serve the nearby community as well — meaning that more than 10,000 additional New Yorkers will have more parks and playgrounds within a 10-minute walk. And here at DVS, our team is growing to enhance service delivery in housing, benefits and outreach—making it easier for veterans and their families to access the support the have earned and deserve to build a more affordable city for working-class New Yorkers.
