The Undue Influence of Israel's Supreme Court

Since the 1980s, the speaker will assert, Israel’s Supreme Court has increasingly yielded undue influence on Israel's diplomatic and security strategy through judicial activism - undue interference in areas outside its proper purview.  The Israeli public, Rothman suggests, is now becoming aware of this complex relation between appointed and elected officials. There are increasing calls for change. How does such activism threaten a proper separation of powers in the government and what needs to be done to fix it? (This is one of two planned talks which will give both sides of this issue.)

Simcha D. Rothman is a member of the Israeli Knesset for the Religious Zionism Party and chairman of the Constitution Law and Justice Committee. Previously, he was the founder and legal adviser of The Movement for Governability and Democracy (Meshilut) and author of the bestselling Hebrew-language book, Supreme Rulers: How Israel Became a Legalocracy (2019). Rothman earned his L.L.M. in Public Law in a joint program between Northwestern University and Tel Aviv University, and his L.L.B. from Bar Ilan University.

The Abraham Accords and Jordan's Unsustainable Position

Israel's ties with Jordan have deteriorated rapidly since the signing of the Abraham Accords in 2020. Refusing to engage in the multilateral diplomatic structures now shaping the Middle East, Amman’s rhetoric toward Israel is increasingly antagonistic. Yet Jordan shares many of Israel's security concerns, relies heavily on Israel for water, gas, intelligence and other security assistance, and also on Israel's new-found partners for financial assistance. Is this position sustainable? What needs to change for the dissonance to resolve?

Jonathan Schanzer is senior vice president for research at the Foundation for Defense of Democracies. A former terrorism finance analyst at the U.S. Department of the Treasury, he is the author of four books on the Middle East, including Gaza Conflict 2021 (2022). He received a BA from Emory University, an MA from the Hebrew University in Jerusalem, and a PhD from King's College London. He was a research fellow at the Middle East Forum in 2002-03.
