Not Done Defending Reproductive Freedoms

The Arizona Supreme Court yesterday upheld an 1864 near-total abortion ban from a time when Arizona wasn't a state, the Civil War was raging, and women couldn't even vote. Arizona Attorney General Kris Mayes is exploring any and all options available to prevent this draconian decision from being implemented.

How did we get here?

The AG's Office fought in the Arizona Supreme Court to harmonize the 1864 near-total abortion ban with the more recent 15-week ban. Attorney General Mayes believed the Arizona Court of Appeals got it right when it ruled that the modern statute superseded the territorial abortion ban. Yesterday, the Arizona Supreme Court struck down that ruling and decided to reimpose a law from 160 years ago.

Every option on the table to protect Arizonans

In a press conference, AG Mayes underlined her commitment to fight like hell to protect providers and Arizonans seeking reproductive health care.

“ The decision made by the Arizona Supreme Court is unconscionable and an affront to freedom. Make no mistake, by effectively striking down a law passed this century and replacing it with one from 160 years ago, the Court has risked the health and lives of Arizonans. ” — Attorney General Kris Mayes

What's next?

This is far from the end of the debate on reproductive freedom. The Attorney General is leaving everything on the table to stop this outrageous decision from going in to effect. Due to legal proceedings, Arizona has up to 60 days to fix this. The AG is also putting together a concrete plan to help providers and patients.
