​​Dear Program Operator,  

​The purpose of this communication is to announce a recent change to the existing procurement resources available in the Download Forms section of the Child Nutrition Information and Payment System (CNIPS).  

​The U.S. Department of Agriculture (USDA) Food and Nutrition Service (FNS) recently clarified the requirement for State Agencies to incorporate a statement of assurance of nondiscrimination compliance into all template Retailer/Vendor/State/local/subrecipient agency agreements. This requirement is stated in Sections X (A, B) and Appendix B of the USDA FNS Instruction 113-1 which provides guidance to State Agencies regarding Civil Rights compliance and enforcement for their nutrition programs and activities.  

​To ensure that the CDSS template agreements meet all FNS Instruction 113-1 requirements, CDSS has updated the following template agreements: 

  • ​CPU 03 - Interagency Agreement for CACFP 
  • ​CPU 04-A - Small Purchase Food Service Agreement (Unitized Meals Only) 
  • ​CPU 04-B - Small Purchase Food Service Agreement (Food Products Only) 
  • ​CPU 05-A - Small Purchase Consulting Services Agreement 
  • ​CPU 19-A - Formal Purchase Food Service Agreement (Unitized Meals Only) 
  • ​CPU 19-B - Formal Purchase Food Service Agreement (Food Products Only) 
  • ​CPU 20 - Formal Purchase Request for Proposal (RFP) Unitized Meals Only 

​All CACFP operators should review the updated template agreements and refer to these templates for all future procurements.  

​The Download Forms section of the CNIPS includes other resources related to procurement activities; these resources, provided by the Community Procurement Unit (CPU), are optional and are intended to assist program operators with navigating procurement in the CACFP. If your organization uses a different contract format, it must comply with FNS Instruction 113-1 regarding the inclusion of a nondiscrimination statement, as applicable.  For information on other requirements for procurement contracts, see Procurement Documents and Procurement Methods
