The U.S. Department of Agriculture (USDA) Food and Nutrition Service (FNS) originally published Policy Memorandum SP-01-2016, CACFP-01-2016, SFSP-01-2016:  Procuring Local Meat, Poultry, Seafood, Game, and Eggs for Child Nutrition Programs in October 2016.  November 2023, USDA FNS reissued an updated Policy Memorandum located at:  Procuring Local Meat, Poultry, Game and Eggs for Child Nutrition Programs | Food and Nutrition Service


Background 

Since the issuance of the October 2016 Policy Memorandum, the USDA FNS received several questions related to buying local meat, poultry, seafood, game, and eggs.  The November Policy Memorandum’s purpose is to clarify food safety regulatory requirements and previous questions and answers.  

The USDA updated questions six, seven, and eight (with an asterisk by the question), which are indicated in the Food Safety Clarifications for Child Nutrition Programs Questions and Answers (Q&A), part III of this revised Policy Memorandum.  The updates are intended to better reflect opportunities to access domesticated and wild game animals, including buffalo, as well as other minor technical updates throughout the Q&A.  The responses to these three questions remind Child Nutrition Program (CNP) Operators to comply with all applicable federal, state, local, and tribal laws regulations. 

This Policy Memorandum outlines the roles and duties of four federal agencies involved in setting rules for meat, poultry, seafood, game, and eggs in CNPs:  

  1. The USDA FNS
  2. The USDA Food Safety and Inspection Service 
  3. The United States (US) Department of Health and Human Services Food and Drug Administration  
  4. The US Department of Commerce National Oceanic and Atmospheric Administration National Marine Fisheries Service  
CNP Operators should also check with their state and local governments; and, if applicable, their tribal nation for any additional regulations.
