Dear <<First Name>>,
We’re sending this update to all sellers in the European Union to notify you about our upcoming distance selling tool.
As an EU seller, if you have exceeded the EUR 10,000 distance selling threshold on BrickLink for the 2021 calendar year and/or 2022 year-to-date, you will receive an email in early July with the next steps you need to take. If you have already enabled distance selling with an OSS registration or foreign VAT IDs, please see FAQs below.
The new EU Marketplace rules went into effect July 1, 2021. Any seller with more than EUR 10,000 worth of distance sales of goods must register with their local tax authorities and charge the VAT rate of the buyer’s country.
To learn more about distance selling, please see the European Commission article on this topic. We’ve also included some FAQs below to help with this transition.
Kind regards,
The BrickLink Marketplace Team
Distance Selling Frequently Asked Questions
Q: How do I manually estimate my previous year’s order totals?
A: To see if the EU distance selling regulation may apply to you, you will need to look at EU cross-border sales total for calendar year 2021 and separately for 2022 year-to-date. Each year will need to be below the 10,000 EUR threshold. The best way to estimate this calculation is to download the basic order information on this page.
Q: Are domestic sales included in the calculation?
A: No, domestic sales are not a part of the calculation. Please only use the total of your EU sales (distance sales) to see if this regulation applies to you.
Q: Are shipping costs included in the calculation?
A: No, shipping costs are not included in the calculation.
Q: What if I’m already over the EUR 10,000 limit?
A: You have two options:
- Register for the One Stop Shop (OSS). Please refer to the FAQ here for more details;
- Register VAT IDs in each individual EU Member State where you sell on BrickLink. More information on rates and regulations can be found here.
Once you obtain your OSS ID number or the VAT IDs for the countries you transact in, you can then enable distance selling on BrickLink. To enable distance selling, go to the Value Added Tax (VAT) section on the Store Settings Management page.
Q: What if I’ve already enabled OSS?
A: If you’ve already enabled OSS, please wait for a confirmation email from our admins. Note this is a review process similar to New Seller Verification (NSV) and this can take up to two weeks. Please contact our Help Desk if you do not receive confirmation before August 10, 2022.
Q: What if I have VAT IDs enabled in some countries?
A: If you’ve already enabled VAT IDs in the countries you transact in, only EU countries without VAT IDs will be blocked from checkout in your store.
Q: What if I receive two emails, one for 2021 and another for 2022?
A: This is expected, as you were over the threshold in both 2021 and 2022 year-to-date. Please refer to the email addressing your 2022 year-to date threshold regarding your distance selling deadline and next steps.
