New Group to Put NoVa’s Radical, Pro-Criminal Prosecutors on Trial
“Recall” petition launched against Fairfax, Loudoun, & Arlington Counties’ Commonwealth’s Attorneys
Falls Church, Virginia – Today, the non-profit Virginians for Safe Communities (VSC) announced its formation and effort to remove the elected Commonwealth’s Attorneys for three Washington, DC suburban counties – Fairfax, Loudoun, and Arlington – via a petition and trial process, set forth in Virginia state code and case law.
“Northern Virginia deserves honest, hard-working, and effective Commonwealth’s Attorneys who seek accountability for criminals, protect our communities, and uphold the law without reservation or ideological blinders,” VSC President Sean Kennedy said.
Financed almost exclusively by outside special interest donors, Steve Descano (Fairfax), Buta Biberaj (Loudoun), and Parisa Dehghani-Tafti (Arlington & Falls Church City) were elected in 2019 by misleading the voters of Northern Virginia about their policies and commitment to public safety. Now more than a year and a half later, our communities are less safe as crime rises, criminals go free, and our chief law enforcement officers prefer political grandstanding to enforcing the law.
Kennedy continued, “These rogue prosecutors’ dangerous policies are costing lives, re-victimizing victims, and undermining the public’s faith in our justice system – it ends now.”
VSC, a 501(c)4 social welfare organization incorporated in Virginia, will deploy significant resources to inform Virginians of the dangerous and unconstitutional actions taken by these elected prosecutors, circulate a removal petition with voters demanding that the Commonwealth’s Attorney face a trial, and – upon an affirmative finding of guilt – be removed from office. Once their offices are vacated, a special election will be called to replace them.
Under Virginia law, elected officials can be removed for cause including:
“For neglect of duty, misuse of office, or incompetence in the performance of duties when that neglect of duty, misuse of office, or incompetence in the performance of duties has a material adverse effect upon the conduct of the office” [§ 24.2-233].
After the signed petitions are submitted to the court, the targeted official faces an expedited trial [by jury, if requested] and the office can be vacated, triggering a special election.
